1. GENERAL

   The Application is operated by Trelleborg  Industrial Products UK Ltd, a company registered in England with registered number 03847966 whose registered office is  International Drive, Tewkesbury Business Park, Tewkesbury, GL20 8UQ, United Kingdom (”TIPUK”)

   By installing the Application (as defined below), you agree to be bound by these terms of use (“Terms”). Please review them carefully before installation and/or acceptance.
   

   
   

2.  DEFINITIONS
   The “Application” shall mean the software provided by Trelleborg  Industrial Products UK Ltd to offer services related to selection of a suitable anti-vibration mount, to be used on Apple iOS and Android OS devices and any upgrades from time to time and any other software or documentation which enables the use of the Application.

    

3. DATA PROTECTION

   Any personal information you supply to TIPUK when using the Application will be used by TIPUK  in accordance with applicable law.

    

4. PROPRIETARY RIGHTS AND LICENCE

   All trade marks, copyright, database rights and other intellectual property rights of any nature in the Application together with the underlying software code are owned either directly by TIPUK or its licensors.

    

5. CONDITIONS OF USE

    You will not, nor allow third parties on your behalf to (i) make and distribute copies of the Application (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Application; or (iii) create derivative works of the Application of any kind whatsoever.

    

   The Application is currently made available to you free of charge for your personal, non-commercial use.

    

   TIPUK reserves the right to amend or withdraw the Application, or charge for the Application or service provided to you in accordance with these Terms, at any time and for any reason.

    

6. AVAILABILITY
   This Application is available to handheld mobile devices running Apple iOS and Android OS Operating Systems.

    

   TIPUK will use reasonable efforts to make the Application available at all times. However you acknowledge the Application is provided over the internet and mobile networks and so the quality and availability of the Application may be affected by factors outside TIPUK’s reasonable control.

   
   TIPUK do not accept any responsibility whatsoever for unavailability of the Application, or any difficulty or inability to download or access content or any other communication system failure which may result in the Application being unavailable.

   TIPUK will not be responsible for any support or maintenance for the Application.
   

   
   

7. SYSTEM REQUIREMENTS

    In order to use the Application, you are required to have a compatible mobile telephone or handheld device, internet access, and the necessary minimum  specifications ('Software Requirements').

   
   The Software Requirements are as follows: Apple iOS devices running iOS 8 onwards, and Android OS devices running Android OS 5 onwards; Language: English, German or Chinese.

   The version of the Application software may be upgraded from time to time to add support for new functions and services.
   

   
   

8. TERMINATION
   TIPUK may terminate use of the Application at any time.

   Upon any termination, (a) the rights and licenses granted to you herein shall terminate; (b) you must cease all use of the Application.
   

   
   

9. LIMITATION OF LIABILITY

    In no event will TIPUK be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of your use or access to the Application, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise.

   TIPUK  is not liable to you for any damage or alteration to your equipment including but not limited to personal injury, damage to the mobile phone, incorrect product selection due to poor input data, computer equipment, handheld device as a result of the installation or use of the Application.

   Nothing in these Terms shall exclude or limit TIPUK ’s liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation or any other liability which cannot be excluded or limited under applicable law.

   Although every effort has been made to ensure the accuracy of the information within this Application, it is your responsibility to verify the accuracy of any and all data presented.

   TIPUK makes no representations or warranties of any kind, expressed or implied, of the completeness, accuracy, reliability or suitability of the information provided by this Application. Any reliance placed on the information obtained through this Application is strictly at your own risk.

   TIPUK reserves the right to change these Terms at any time without notice to you by updating the Application to incorporate the new terms of use. You are responsible for regularly reviewing information posted online to obtain timely notice of such changes. Your continued use of the Application after changes are posted constitutes your acceptance of the amended Terms.
   

   
   

10. SEVERABILITY

     If any of these terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction which that term is illegal, invalid or unenforceable, it shall be severed and deleted and the remaining Terms shall survive, remain in full force and effect and continue to be binding and enforceable.

     

11. ENGLISH LAW & JURISDICTION

These Terms and your use of the Application (and all non-contractual relationships arising out of or connected to it) shall be governed by and construed in accordance with English law. You submit to the exclusive jurisdiction of the English courts to settle any dispute or claim which may arise under, or in respect of, these Terms or your use of the Application.
